Order 14418, dated August 6, 2026, lists categories of children without citizenship recognition. It does not mention children of undocumented immigrants.
On August 6, 2026, President Donald Trump signed Executive Order 14418, which establishes categories of U.S.-born children whom federal agencies will not recognize as citizens. The order was issued after the Supreme Court ruled on June 30, 2026, in the case Trump v. Barbara.
The official documents consulted show a different picture than a "partial" application of the original 2025 order: the Court resolved the case on the merits and the White House issued a new order.
The Supreme Court published its opinion in the record 25-365, dated June 30, 2026, and a revised version dated July 1. According to the text of Order 14418, the court held that the Citizenship Clause grants citizenship to children born in the country to parents "for whom no extraterritorial fiction applie[s]".
The order 14418 It applies when neither parent is a U.S. citizen and one of the following conditions is met, which the text describes as not exhaustive:
- one of the parents is a member of a designated foreign terrorist organization or a specially designated global terrorist;
- one of the parents is an ambassador, an employee of a foreign government in official capacity, or an employee of an international organization with immunity;
- one of the parents participated in a commercial transaction to purchase or obtain birthright citizenship, or in fraud to obtain it, including commercial surrogacy arrangements;
- The person was born in a U.S. territory where federal law does not grant citizenship.
The order does not mention the children of undocumented immigrants or people with temporary visas among those categories. It does not set an effective date. It orders the Secretaries of State and Homeland Security, the Attorney General, and the Social Security Commissioner to align their rules and policies, and requires all agencies to publish public guidance within 30 days of the order's date.
What does it mean to you?
- The text of the order does not include children of undocumented parents or those with temporary visas among the categories it lists.
- Agencies must publish application guides; these should be consulted on the official websites of the State Department, the Department of Homeland Security, and the Social Security Administration.
- If you have questions about your family's case, consult an immigration lawyer or an accredited legal organization.
