La ACLU de Puerto Rico rechaz\u00f3 el domingo 25 de octubre el despliegue de agentes del Servicio de Inmigraci\u00f3n y Control de Aduanas (ICE) en comunidades de la isla y advirti\u00f3 que grabar sus operativos est\u00e1 protegido por la Primera Enmienda. La organizaci\u00f3n tambi\u00e9n dijo que ha recibido denuncias de amenazas contra residentes que documentaban esas intervenciones.<\/p>\n

Qu\u00e9 dijo la ACLU de Puerto Rico<\/h2>\n

Seg\u00fan la agencia EFE, la directora ejecutiva de la organizaci\u00f3n, Annette Mart\u00ednez Orabona, habl\u00f3 de un \u00abpatr\u00f3n de violencia sistem\u00e1tica y acecho contra nuestras comunidades inmigrantes\u00bb. La ACLU sostiene que agentes con armas largas patrullan comunidades con residentes inmigrantes en varios municipios y denuncia arrestos sin orden judicial y separaci\u00f3n de familias.<\/p>\n

La organizaci\u00f3n record\u00f3 que grabar, documentar y protestar las intervenciones de ICE es un derecho y que nadie debe sentir miedo o intimidaci\u00f3n por ejercerlo. Esas son afirmaciones de la ACLU: hasta la publicaci\u00f3n de esta nota no encontramos una respuesta de ICE ni del Departamento de Seguridad Nacional (DHS) a las denuncias de amenazas, y los casos concretos no han sido verificados de forma independiente.<\/p>\n

La ACLU tambi\u00e9n acusa a la gobernadora Jenniffer Gonz\u00e1lez Col\u00f3n y al secretario del Departamento de Transportaci\u00f3n y Obras P\u00fablicas, Edwin Gonz\u00e1lez Montalvo, de haber entregado de forma voluntaria direcciones e informaci\u00f3n confidencial de m\u00e1s de 6,000 inmigrantes. El reporte de EFE no detalla c\u00f3mo ni cu\u00e1ndo se habr\u00edan compartido esos datos, y no incluye una verificaci\u00f3n independiente ni la respuesta del gobierno.<\/p>\n

What is confirmed and what is not<\/h2>\n

La nota parte de lo que la organizaci\u00f3n afirma p\u00fablicamente. No est\u00e1 confirmado por fuentes oficiales el contenido de las amenazas, la identidad de los agentes involucrados ni la cifra de m\u00e1s de 6,000 personas. Este medio ya inform\u00f3 antes de un enfrentamiento entre vecinos y agentes durante un operativo en San Juan.<\/p>\n

Qu\u00e9 dice la gu\u00eda de la ACLU sobre grabar a agentes<\/h2>\n

En su gu\u00eda nacional \u00abRecording and Documenting Police and Federal Agents\u00bb, actualizada el 8 de junio de 2026, la ACLU explica que la Primera Enmienda protege tomar fotos y videos de agentes que cumplen sus funciones en p\u00fablico, incluidos los de ICE. A\u00f1ade que algunos agentes responden con amenazas, irritantes qu\u00edmicos o arrestos, por lo que conviene considerar los riesgos.<\/p>\n

Sobre el tel\u00e9fono, la gu\u00eda indica que, si no est\u00e1s detenido, el gobierno necesita una orden judicial para confiscarlo o ver su contenido sin tu consentimiento. Si te arrestan, pueden quedarse con el aparato, pero a\u00fan necesitan una orden para revisarlo. Seg\u00fan la gu\u00eda, el gobierno nunca puede borrar tus fotos o videos.<\/p>\n
