Salvadorans with Temporary Protected Status (TPS) who receive Social Security retirement pensions report letters from the agency suspending their payments for lack of legal presence, according to press reports from mid-October. The Social Security Administration (SSA) had not publicly explained those letters as of the publication of this article, and the individual cases have not been confirmed by official sources.<\/p>\n

What is known and what is not<\/h2>\n

Reports describe retirees with TPS who received a notice suspending their pensions. These are individual testimonies: there is no official count of those affected and no SSA statement confirming a general measure.<\/p>\n

What is confirmed on official pages is the status of TPS. The U.S. Citizenship and Immigration Services (USCIS) page about El Salvador<\/a> indicates that protection continues until September 9, 2026 and that \u201cAn announcement on El Salvador’s TPS will be made at the appropriate time,\u201d that is, the announcement will be made \u201cat the appropriate time.\u201d Meanwhile, according to that page, beneficiaries keep their protection and work authorization. The page was updated on October 7, 2026.<\/p>\n

What Social Security says about TPS<\/h2>\n

The SSA pays monthly benefits<\/a> to anyone who is a citizen, national, or noncitizen with legal presence. In the section RS 00204.025<\/a> of its Program Operations Manual System (POMS), the agency includes among those who can prove legal presence a noncitizen who is currently under TPS. The evidence may be a Form I-94 with the TPS registration notation or an employment authorization document (EAD) with category A12.<\/p>\n

The same section states that if a person says they are under TPS and presents an expired I-94 or EAD, the document is accepted as evidence of their status, as an exception to the general rule about valid documents. It also warns that TPS is not permanent and that staff must verify the country remains on the list of designated countries.<\/p>\n

The official sources reviewed do not explain why the letters were sent or the criteria the SSA applied to the reported cases. There is also no official confirmation that the agency considers El Salvador\u2019s TPS to have ended.<\/p>\n

How did we get here?<\/h2>\n

El Salvador\u2019s TPS designation dates to March 9, 2001, according to USCIS. The most recent extension was published in the Federal Register on January 17, 2025 (90 FR 5953), with re-registration from January 17 to March 18, 2025. The validity period ran through September 9, 2026, without USCIS publishing a new decision.<\/p>\n
