DHS they may request, without paying a fee, that an adverse decision on an immigration matter be reopened or reconsidered. The option responds to an order from the U.S. District Court for the District of Massachusetts dated September 28, 2026, according to the official USCIS notice.

What the court ordered

The order requires the Department of Homeland Security (DHS) to remedy certain adverse consequences for people who received parole after scheduling an appointment through the CBP One mobile app and whose parole the federal government terminated through mass email in April 2025. The case is docketed as 1:25-cv-12245-ADB.

According to USCIS, the court vacated those emails on March 31, 2026, and ordered parole reinstated for all class members. On April 21, 2026, U.S. Customs and Border Protection (CBP) updated government databases to restore parole periods and issued new termination notices. USCIS clarifies that the September 28 order does not affect those new notices.

Who is in the class

According to USCIS, the class includes those who scheduled their entry appointment with CBP One, received parole in the United States between May 16, 2023, and January 19, 2025, and had their parole terminated in April 2025 through an email reading “It is time for you to leave the United States” or similar language.

USCIS also indicates that, under the March 31 order, those emails had no legal effect and DHS may not use them to deny applications, to decide admissibility or detention, or to accumulate unlawful presence under sections 212(a)(9)(B) and (C)(i) of the Immigration and Nationality Act.

Which decisions can be reopened

A class member may file the request if they believe the adverse decision was made as a result of the April 2025 parole termination. USCIS sets the following conditions:

USCIS must have issued the original decision between April 1, 2025, and April 21, 2026.

Applications for work permits based on parole are excluded.

There is no deadline to file the request.

“Adverse decision” means that the application was denied, dismissed, considered abandoned, administratively closed, rejected, or referred to the Executive Office for Immigration Review (EOIR).

How it is filed and how it is evaluated

The request must be filed on the form USCIS designates, following its instructions. The notice refers to the class-member instructions on the Form I-589 page for asylum applications and on the Form I-290B page for other types of benefits.

The request must explain how the parole termination affected eligibility for the benefit and why USCIS should reopen or reconsider. Each case is reviewed individually and can be approved only if the person shows they are eligible without considering the parole termination.

The no-fee process does not include appeals. If the type of application allows an appeal, the usual procedures and requirements apply.

If there is a deportation proceeding

USCIS notes that people in removal proceedings must, in order to request reopening of an asylum application and, in some cases, adjustment of status, have obtained the result before the immigration judge terminates or dismisses the case, except in limited circumstances. If USCIS no longer has jurisdiction because of the pending case, it will reject or deny the request.

What does it mean to you?

If you received parole after a CBP One appointment and got the April 2025 email, check whether your USCIS decision was issued between April 1, 2025, and April 21, 2026.

There is no fee for this request and no deadline to file it, but it cannot be used for work permits based on parole or to appeal.

If you have a case before an immigration judge, the rule changes: consult an attorney or an accredited organization first.

Read the instructions for this class on the USCIS pages for Forms I-589 and I-290B, and be wary of anyone who charges to “process” this option.

A Massachusetts court order of September 28 opens the process for parolees with CBP One whose parole was terminated by mail in April 2025.

Una orden de un tribunal de Massachusetts del 28 de septiembre abre el trámite para paroleados con CBP One cuyo parole se terminó por correo en abril de 2025.
USCIS: litigation update on the Sileiri Doe class
https://www.uscis.gov/newsroom/alerts/litigation-related-update-sileiri-doe-class-members-may-request-reopening-or-reconsideration-of-an

F1
[202
649,651,197,650,84
post-1801","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-comunicados","tag-cbp-one","tag-i-290b","tag-parole","tag-sileiri-doe","tag-uscis

Sileiri Doe: Reopen USCIS decisions without fee

<meta name="description" content="USCIS informs members of the Sileiri Doe class that they can request, without fee, to reopen adverse decisions.
