The Department of Homeland Security (DHS) announced, according to reports published between October 20 and 21, 2026, a nationwide operation by U.S. Immigration and Customs Enforcement (ICE) against people without legal status accused of fraudulently obtaining benefits from the Supplemental Nutrition Assistance Program (SNAP, formerly known as food stamps). The reports describe five initial arrests: four Haitian nationals and one Cuban woman.<\/p>\n

This newsroom was unable to consult the original DHS statement, so those figures have not been confirmed by an official source. Nor, as of publication of this note, are there total figures for detainees, amounts attributed to each person, or specific SNAP charges in court documents.<\/p>\n

What is known and what is not<\/h2>\n

According to those reports, DHS described the arrests as the start of a sustained, large-scale operation. It has not been explained how the alleged fraud was detected or whether there are criminal cases for SNAP. A DHS accusation is not a conviction.<\/p>\n

A headline circulating in some outlets, claiming ICE \u201cwill detain undocumented immigrants who received SNAP in 2026,\u201d is not backed by an official document this newsroom has been able to access. It should not be read as a new rule affecting any family that receives the benefit.<\/p>\n

What the federal rule says about who can receive SNAP<\/h2>\n

The Food and Nutrition Service (FNS) of the U.S. Department of Agriculture (USDA) explains in its memo on the OBBB law<\/a> that Section 10108 limited SNAP to citizens, nationals, lawful permanent residents, Cuban and Haitian entrants, and citizens of the Freely Associated States. Lawful permanent residents generally must wait five years, with exceptions for people under 18, people with a disability, or those who have earned 40 quarters of work.<\/p>\n

The same document notes that SNAP has never been extended to undocumented people and that states must verify immigration status through the SAVE system. Cuban and Haitian entrants, a category defined by law, may qualify if they meet the other requirements, so having those nationalities does not by itself indicate fraud.<\/p>\n

A separate offensive, distinct from ICE\u2019s<\/h2>\n

Separately, the Justice Department reported that between September 1 and October 21, 2026, its Fraud Division, 13 U.S. attorney\u2019s offices and the U.S. Attorney\u2019s Office for Utah carried out the first national offensive against fraud in USDA programs<\/a>. The action targeted more than 40 defendants and nearly $45 million in intended losses, of which nearly $42 million involved SNAP.<\/p>\n

The examples cited are of a different kind: stores accused of processing fraudulent transactions using stolen EBT card data, and a merchant accused of exchanging cash for benefits. Much of the fraud targeted in that offensive involves merchants and networks, not families who receive aid.<\/p>\n

  • As a general rule, only certain categories of immigrants qualify for SNAP; undocumented people do not, but a citizen or eligible child can receive the benefit in the household.<\/li>\n
  • If you have questions about your immigration category and SNAP, consult an immigration attorney or a trusted legal organization before you stop using or apply for the benefit.<\/li>\n
  • Rule changes are published on the USDA website (fns.usda.gov) and by the state agency that administers your case.<\/li>\n<\/ul>\n

    What's next?<\/h2>\n
